Effort to rescind the parental consent requirement for school-based health services

The Local Education Agency Network, or LEAnet, is coordinating a nationwide effort by schools to rescind the parental consent requirement for school-based health services that schools are mandated to provide to students with IEPs.

Participants in school-based Medicaid reimbursement programs have seen the effect of the parental consent requirement. According to LEAnet, this federal regulation1 has “destroyed programs seeking Medicaid reimbursement for covered services provided pursuant to an IEP.”

At this time of dwindling budgets, it’s more important than ever that schools have the funding required to provide these federally-mandated services, and this requirement serves as an impediment that should be removed. Please join schools nationwide that are contacting the U.S. Secretary of Education, Arne Duncan, and asking him to rescind this requirement. A sample message that you can send:

“To the Honorable Arne Duncan:

Please rescind the parental consent regulation for school-based Medicaid reimbursement.
