Moratoria passed! - posted July 3, 2008

Over the weekend of June 28, 2008, President Bush signed the War Supplemental funding bill, which included moratoria until April 2009 on six of the proposed Medicaid cuts, including the Administrative Claiming Program and specialized transportation (from home to school and back). Thank you for all all of your efforts. Although our work is not done, we can take a well-deserved reprieve before gearing up for the next battle.

 

Education and Health Organizations seek Moratoria Extension - posted January 28, 2008

As a result of the January 22, 2008 LEAnet meeting, a letter was drafted and sent to House and Senate members requesting their assistance in extension of moratoria regarding a number of recent CMS actions including CMS-2287-F (elimination of school-based Medicaid reimbursement for Administrative Claiming and Transportation). We have put up a page urging concerned parties to contact members of Congress to oppose CMS' plan to eliminate reimbursements for specialized transportation for children with disabilities and administrative activities that support the state Medicaid plan.

 

Federal Program Cuts - posted October 4, 2007

Under current federal regulations, LEAs can receive Medicaid reimbursement for the cost of transporting children with disabilities who because of their disability cannot ride the regular school bus.  Additionally, LEAs can receive Medicaid reimbursement for the cost of administrative activities that are in support of the state Medicaid plan (Administrative Time Study Program). 

On September 7, Centers for Medicare and Medicaid Services (CMS) issued a Notice of Proposed Rule Making (NPRM) (CMS–2287–P - PDF file) that would eliminate Medicaid reimbursement for specialized transportation from home to school and back for children with disabilities.  It would also eliminate Medicaid payments for administrative activities performed by school employees.

The PA Department of Education, Department of Public Welfare and Leader Services, along with other state agencies and National Organizations strongly oppose the CMS proposal that would eliminate these programs. We are collaboratively strategizing to stop CMS from implementing these cuts that would shift the total cost burden for these services onto LEAs.

If the proposed rule is allowed to stand, PA schools stand to lose annually approximately $10M and $12M respectively in transportation and ATS reimbursement.  The cuts would be effective October 1, 2008.
